Documentos de identidadMale, female, or non-binary; surgery cannot be required

The sex designation on an act of birth is the sex attested at birth, or the person's gender identity if that identity does not correspond to the sex attested at birth. The designation uses letter symbols for male, female, and non-binary. A person may change the designation, and given names if needed. The change cannot depend on medical treatment or surgery. A minor 14 or older may apply. Under 14, the tutor applies.

PrisionesPlaced by gender identity

For a federal sentence of two years or more, placement after intake follows gender identity or expression, regardless of anatomy, unless a health or safety problem cannot be resolved. A federal research report looked at 99 offenders recorded as identifying as transgender. The largest group, 62 percent, were trans-identified males. Sixteen percent applied to move to an institution matching their gender identity, and 64 percent of those applications were approved.
